Terms & Conditions & Client Agreement

1. Introduction

These terms and conditions ("Agreement") govern the relationship between Amneris Dominguez, an independent travel advisor doing business as NeriBooksTravel ("Travel Advisor" or "we"), and you, the purchaser of travel services or lead traveler ("Client" or "you").

By working with NeriBooksTravel, you agree to be bound by the terms of this Agreement.


2. Use of Travel Advisor Services

By using our services, you confirm that:

  • You are at least 18 years old and authorized to enter into this Agreement

  • All information you provide is accurate and will be kept updated

  • You will abide by the terms of this Agreement and those of all travel suppliers


3. Independent Travel Advisor Relationship

NeriBooksTravel is an independent business affiliated with Fora Travel, Inc., a host agency and technology provider. You understand and agree that:

  • NeriBooksTravel is not an employee, agent, or legal representative of Fora Travel

  • Fora is not responsible for any part of your trip or related services

  • You will not bring any legal claim against Fora related to services provided by NeriBooksTravel

  • Fora is not a party to this Agreement


4. Planning Fees & Scope of Services

Travel planning services may include custom itinerary design, supplier coordination, and booking support for accommodations, tours, transfers, and other services.

  • Planning fees are non-refundable, regardless of whether travel is booked or completed

  • Fee amount varies depending on trip complexity, length, and group size

  • Fee must be paid in full before planning begins

  • Submission of payment confirms your acceptance of this Agreement


5. Suppliers & Client Responsibility

You acknowledge that:

  • Third-party suppliers (e.g., airlines, hotels, tour companies) are responsible for providing your travel services

  • Travel Advisor acts as a liaison but does not control these suppliers

  • All bookings are subject to the supplier's own terms, including cancellation/change/refund policies

  • You are responsible for reviewing those policies and understanding any risks


6. Travel Bookings & Payments

  • Quotes & Pricing: All prices are in USD unless noted and may fluctuate due to dynamic pricing and availability

  • Booking Confirmation: Services are not guaranteed until confirmed by the supplier and applicable deposits are paid

  • Payment: You may be required to pay the supplier directly or through Fora Travel as instructed

  • Personal Information: You authorize us to share your information with suppliers solely to facilitate your bookings


7. Credit Cards, Disputes & Chargebacks

By providing your credit card information:

  • You confirm you are an authorized user

  • You authorize charges for agreed-upon travel services

  • You agree not to initiate a chargeback unless the product or service was not delivered or grossly misrepresented

  • You must first allow the Travel Advisor a reasonable opportunity to resolve any issue with the supplier

  • Unauthorized chargebacks may be subject to legal fees and recovery costs


8. Insurance & Trip Protection

Travel insurance is not included unless purchased by you separately. We strongly recommend purchasing comprehensive insurance that includes:

  • Trip cancellation and interruption

  • Medical emergencies and evacuation

  • Lost baggage, delays, or supplier bankruptcy

Without insurance, you accept full financial risk for any cancellations or emergencies.


9. Passports, Visas & Entry Requirements

You are solely responsible for ensuring:

  • You have a valid passport (with at least 6 months validity after travel)

  • You obtain all necessary visas and travel authorizations

  • You comply with all government entry and health requirements

  • Minors in your group have appropriate travel documentation

Being denied entry or boarding due to missing or incorrect documents does not entitle you to a refund.


10. Travel Advisories & Assumption of Risk

You understand that:

  • Travel involves inherent risks, including weather, strikes, political unrest, health concerns, or pandemics

  • Government advisories may change at any time and do not override supplier cancellation/refund policies

  • You travel at your own risk and are encouraged to review U.S. State Department advisories at travel.state.gov

  • Booking services with NeriBooksTravel indicates your voluntary acceptance of these risks


11. Group Travel

For group bookings (8+ travelers):

  • One lead traveler must serve as primary contact

  • All group members are individually responsible for reviewing terms and making payments

  • Group trip deposits may be non-refundable and subject to different supplier conditions

  • NeriBooksTravel is not responsible for individual actions that affect the group booking


12. Modifications, Cancellations & Refunds

  • You must provide at least 48 hours' notice for cancellation or change requests

  • Any fees or penalties assessed by the supplier are your responsibility

  • NeriBooksTravel is not liable for losses resulting from changes, cancellations, or delays caused by suppliers

  • Refunds are not guaranteed unless specifically offered by the supplier


13. Testimonials, Photos & Marketing Content

Clients grant permission for written testimonials, reviews, and voluntarily shared images to be used for marketing on:

  • neribookstravel.com

  • Social media (Instagram, Facebook, LinkedIn, etc.)

  • Email campaigns

  • Blog posts and Substack

  • Fora Travel profile and marketing materials

If you prefer not to be featured by name or photo, please notify us in writing.


14. Limitation of Liability

Travel Advisor is not responsible for:

  • Acts, errors, or omissions of any supplier

  • Injury, death, property damage, delays, or disruptions

  • Force majeure events (e.g., weather, strikes, government actions, pandemics, war, terrorism)

You release NeriBooksTravel from liability for any losses beyond the commission and fees received for your booking.


15. Governing Law & Legal Claims

This Agreement is governed by the laws of the State of Illinois.
Any legal action or dispute must be filed in Chicago, Illinois, and:

  • Must be filed within 12 months of trip completion

  • May not be brought as a class action

  • Is limited to compensatory damages only (no punitive damages)


16. Miscellaneous

  • Amendments: Terms may be updated without notice; current terms apply at time of booking

  • Severability: If any part of this Agreement is found unenforceable, the rest remains in effect

  • Entire Agreement: This is the full agreement between you and NeriBooksTravel


17. Acceptance of Terms

By paying a planning fee, submitting travel information, or confirming any services with NeriBooksTravel, you acknowledge that you have read, understood, and agree to the terms and conditions outlined above.
